Terms of Service — BizPulse

1. Acceptance of Terms

By registering for BizPulse, using the web dashboard at mybizpulse.app, or sending messages to the BizPulse WhatsApp number, you agree to be bound by these Terms of Service.

If you do not agree to these terms, you must not use BizPulse. These Terms of Service form a legally binding agreement between you and The Tosin Ilesanmi Data Academy, the entity that operates BizPulse.

We may update these Terms from time to time. Continued use of BizPulse after any update constitutes your acceptance of the revised Terms. We will notify you of material changes via WhatsApp at least 14 days before they take effect.

2. Service Description

BizPulse is a WhatsApp-native financial operating system for small business owners. The service includes:

WhatsApp financial tracking: Log your daily revenue, expenses, and customer count by sending a natural-language message to the BizPulse WhatsApp number
Inventory tracking: Track stock levels by sending stock-in and stock-out messages; receive low-stock and out-of-stock alerts automatically
7pm daily summary: Receive a personalised business summary every evening by WhatsApp and email, including AI-generated insights and recommendations
Web dashboard: View your business performance, financial history, and inventory status at any time via the BizPulse web application
On-demand reports: Request a summary of your business numbers at any time by sending "summary" to BizPulse on WhatsApp or clicking the Send Summary button on the dashboard

We reserve the right to modify, suspend, or discontinue any part of the service at any time. We will provide reasonable notice where possible.

3. Registration

To use BizPulse, you must create an account by providing your name, business name, business type, WhatsApp number, and email address.

Accurate information: You are required to provide accurate and complete information at registration and to keep it up to date. Providing false information may result in account suspension.

Account security: You are responsible for maintaining the security of your account. BizPulse is linked to your WhatsApp number — anyone with access to your WhatsApp account can send financial entries on your behalf. Keep your phone secure.

One account per person: Each individual or business may hold one BizPulse account. Creating duplicate accounts is not permitted.

4. Acceptable Use

You agree to use BizPulse only for lawful purposes and in accordance with these Terms. You must not:

Submit false or fabricated data — entries must reflect genuine business transactions
Process data relating to illegal activity — BizPulse must not be used to track or facilitate transactions that are unlawful under Nigerian law or the laws of your jurisdiction
Attempt to access other users' data — you may only access the account and data associated with your own registration
Reverse engineer or copy the service — you may not decompile, disassemble, or reproduce any part of the BizPulse application or its underlying code
Interfere with the service — you may not take any action that places an unreasonable load on our infrastructure, send automated messages, or attempt to disrupt the BizPulse system
Resell or sublicense the service — BizPulse is for your own business use and may not be resold or offered to others as a service

Violation of these terms may result in immediate account suspension or termination without notice.

5. Financial Disclaimer

        BizPulse is not a licensed accountant, financial advisor, tax consultant, or auditor. The insights and recommendations generated by BizPulse are informational only and do not constitute professional financial advice.
      

The AI-generated business insights, health scores, margin calculations, and coaching responses provided by BizPulse are based solely on the data you submit. They are intended to help you understand your own numbers — they are not a substitute for advice from a qualified financial professional.

You should not make major financial decisions — such as taking on debt, signing lease agreements, or making large capital investments — based solely on BizPulse outputs without consulting a qualified accountant, financial advisor, or business consultant.

BizPulse accepts no responsibility for any financial loss, business decision, or outcome arising from reliance on the insights, summaries, or recommendations generated by the service.

6. Data Ownership

You own your data. All financial entries, inventory records, and business information you submit to BizPulse remain your property at all times.

BizPulse holds your data on your behalf solely for the purpose of providing the service described in these Terms. We do not claim any ownership over your business data, and we do not use your individual business data for any purpose beyond operating the BizPulse service.

You may export all of your data at any time as a CSV file using the Settings screen in the web dashboard or by using the export endpoint. You may request full deletion of your data at any time — see Section 8 (Termination) for details.

7. WhatsApp Messaging Consent

By registering for BizPulse and providing your WhatsApp number, you consent to receiving the following types of WhatsApp messages from BizPulse:

Entry acknowledgements: Instant reply confirming each financial entry you send, including your daily totals and streak
7pm daily summaries: Automated evening summary sent every day, including your revenue, profit, margin, and AI-generated insights
Retention nudges: Reminder messages sent when you have not logged for 3, 5, 7, or 14 consecutive days
Milestone celebration messages: Messages sent when you reach streak or entry milestones (Day 7, Day 30, Day 100 streak; first profitable day; 10th entry)
Low stock and out-of-stock alerts: Notifications when an inventory item falls below the threshold or reaches zero
Welcome and onboarding messages: Messages sent when you first register your account

To opt out of non-essential messages (retention nudges and milestone messages), send STOP REMINDERS to BizPulse on WhatsApp. Entry acknowledgements and daily summaries are core service messages and cannot be disabled while your account is active.

Message and data rates from your mobile carrier may apply. BizPulse does not charge separately for WhatsApp messages.

8. Termination

You may close your account at any time by either:

Sending DELETE MY ACCOUNT to BizPulse on WhatsApp
Emailing tosinilesanmi93@gmail.com with a deletion request

Upon receiving a deletion request, all personal data and financial entries associated with your account will be permanently deleted within 30 days. We recommend exporting your data before requesting deletion if you wish to retain your records.

Termination by BizPulse: We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or use the service in a way that harms other users or the service itself. We will attempt to notify you before suspension except where immediate action is necessary.

Termination of your account does not affect any rights or obligations that arose before termination.

9. Limitation of Liability

BizPulse is provided on an "as is" and "as available" basis. To the maximum extent permitted by Nigerian law, The Tosin Ilesanmi Data Academy and its operators:

Make no warranty that the service will be uninterrupted, error-free, or free of data loss
Are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use BizPulse
Are not liable for any loss of revenue, loss of profit, loss of data, or loss of business opportunity arising from reliance on BizPulse outputs
Are not liable for any actions taken by third-party services (Meta, Google, Anthropic, Render, Brevo) in connection with the delivery of BizPulse features

Where liability cannot be excluded by law, our total liability to you for any claim arising from these Terms or your use of BizPulse shall not exceed the total amount you have paid to us in the 12 months preceding the claim (or NGN 10,000, whichever is greater).

10. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Federal Republic of Nigeria, including but not limited to the Nigeria Data Protection Act 2023, the Consumer Protection Council Act, and any applicable regulations of the Federal Competition and Consumer Protection Commission (FCCPC).

Any dispute arising from or in connection with these Terms that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of Lagos State, Nigeria.

If you are using BizPulse from outside Nigeria, you are responsible for ensuring compliance with the laws of your own jurisdiction.
